Form 3301(c)(1) Counter-Affidavit
The (c)(1) Counter-Affidavit is a form the defendant (the spouse who didn’t file for divorce) can use in a Pennsylvania divorce case to officially say, “I don’t agree with what you said” in the other spouse’s divorce affidavit filed under Section 3301(c)(1) of the law.

This form must be filed within 20 days of getting the original affidavit. If the defendant doesn’t respond in time, it’s like they’re automatically agreeing with everything in the original affidavit.
But – if the defendant doesn’t want to fight the divorce and isn’t asking for anything like money, property, or support – they don’t need to file this form at all.
With this form, the defendant can push back on things like:
- The date of separation
- The reason for the divorce
- Or any other important facts they think are wrong
When the defendant fills it out, they’re swearing that everything they say in the counter-affidavit is true – and if they lie, there could be legal consequences for making false statements.
